Terms & Conditions

1. Scope

These terms and conditions apply to all contracts for musical services between Ellie X Parker, Mollardgasse 2, 1060 Vienna, Austria (the “Artist”) and the respective client. Deviating terms of the client apply only if confirmed in writing.

2. Subject of the contract

The contract covers live performances, studio and vocal recordings, songwriting services and other agreed artistic work. Type, duration, location and scope follow from the respective written agreement.

3. Conclusion of contract

Enquiries by email or telephone are non-binding. A contract is concluded only upon written confirmation (email is sufficient).

4. Fees and payment

Fees, payment terms and all other conditions are agreed individually for each enquiry and set out in writing in the confirmation. Travel, accommodation and catering costs are agreed separately.

5. Cancellation

Terms for cancellation and cancellation fees are likewise agreed individually in the respective confirmation.

If the Artist is unable to perform due to force majeure, illness or other reasons beyond her control, the client will be informed immediately. In this case no fee is owed and further claims are excluded. Where possible, an alternative date or substitute line-up will be offered.

6. Client obligations

Unless agreed otherwise, the client provides a suitable weather-protected stage, power supply, PA system and a lockable dressing or rest room. Required permits as well as registration and payment of fees to collecting societies (e.g. AKM / austro mechana) are the client's responsibility.

7. Copyright and neighbouring rights

All copyright and neighbouring rights in the performed works remain with the Artist or the respective rights holders. Photo, audio and video recordings of the performance and their publication require prior written consent.

8. Liability

The Artist is liable only for intent and gross negligence. Liability for slight negligence is excluded, except in cases of personal injury. The client is liable for damage to equipment brought along where caused by the client or their guests.

9. Data protection

Personal data is processed in accordance with our privacy policy.

10. Final provisions

Amendments require written form. Should any provision be invalid, the remaining provisions remain unaffected. Austrian law applies, excluding its conflict-of-law rules. Place of jurisdiction is Vienna, as far as legally permissible.
